Brand Modification Rights

Brand can edit, re-cut, or alter your content (including likeness and voice) without your approval over the final version.

Show it
Look in the brand- rights or content- rights section for phrases like "modify creator content", "edit creator's submitted material", "re-cut", "re-voice", "re-caption", "in the brand's sole discretion", "without creator approval", or "as the brand sees fit".
Decode it
Modification rights let the brand change what you delivered. Edits can shift the creative intention, re-contextualise your message, or attach your name and likeness to framings you would not have endorsed. Without notice-of- modification or approval- over-final rights, you may not see the modified version until it is public.
Fix it
Push for: limitation to non- substantive edits (format, sizing, typo); creator notice or approval over substantive changes; context limitations (named campaigns, named channels); refusal of paired moral-rights waiver where your reputation or political associations are part of the engagement value.

What it means

This contract gives the brand the right to change what you delivered, edit, re-cut, re-caption, re-voice, or otherwise alter your content (including your likeness or voice) without needing your approval over the final modified version.

Modification rights change what your work says. Brand edits can shift the creative intention, re-contextualise your message, or attach your name to framings you would not have endorsed independently. Without notice-of- modification or approval- over-final rights, you may not see the modified work until it is public.

What to check before you sign

  • ·What scope of modification is permitted (non-substantive only vs unlimited)?
  • ·Do you have notice or approval rights over substantive edits?
  • ·Is the modification right paired with a moral-rights waiver?
  • ·Does the right apply to your likeness and voice, or only to delivered footage?
  • ·Are modifications limited to agreed contexts and channels?

How to fix it

  • moderate

Limit modification rights to non- substantive edits (format conversion, sizing, typo correction) with substantive changes requiring creator approval.

  • moderate

Add creator notice rights or approval rights over the final modified version before publication.

  • moderate

Limit modification rights to defined contexts (named campaigns, named channels, defined timeframes).

  • harder

Where the modification right is paired with a moral- rights waiver, refuse the waiver or limit it to specific agreed edits.

Negotiating it

A good opening

"Could we narrow the modification rights to non- substantive edits, with Creator approval over any substantive changes to the creative or messaging? "

When to walk away

Unfettered brand modification rights combined with moral-rights waiver, no notice requirement, indefinite duration, and broad likeness / voice scope, creates a structure where creator content can be materially re-purposed without creator awareness or approval. Strong walk- away signal, particularly where the creator's reputation or political associations are part of the engagement value.
