Caution

Creator Approval Rights Absent

Brand has approval over your work; you have no matching approval over how the brand uses it, a reciprocity gap.

Show it
Look in the approval, brand rights, or content-use section. The finding fires when the brand has approval rights over Creator submissions but the contract is silent on (or expressly waives) Creator's matching approval over brand use, placement, context, or co-promotion.
Decode it
Approval reciprocity is where reputation risk sits. Brand-only approval lets the brand decide unilaterally how your content, likeness, and voice are contextualised - including political pairings, controversial partners, or adjacent categories you would have declined. Your only recourse after publication is moral- rights or right-of- publicity litigation - expensive and after the fact.
Fix it
Push for at minimum: narrow Creator approval over defined sensitive contexts (political, controversial, adjacent category); objection rights within a defined response window; context- bounded brand use (named campaigns, named channels); or refusal of paired moral-rights waiver.

What it means

This contract gives the brand approval rights over what you deliver, but does not give you matching approval rights over how the brand uses your content afterwards. The brand decides where your content appears, what products or causes it is paired with, and how your name and likeness are contextualised, without needing your sign-off.

Approval reciprocity is where creator reputation risk is typically located. The brand deciding unilaterally how your name and likeness are used can pair you with products, political framings, or market positions you would have declined independently. The creator's only practical recourse after publication is moral-rights or right-of- publicity litigation, procedurally expensive and procedurally after the fact.

What to check before you sign

  • ·Do you have any approval rights over brand use of your content?
  • ·Are there narrow approval rights over specific contexts (political pairings, controversial partners)?
  • ·Can you object to specific placements or co-promotion structures?
  • ·Is brand use bounded by defined campaigns or channels?
  • ·Is the lack of approval paired with moral-rights waiver?

How to fix it

  • moderate

Add narrow creator approval rights over defined contexts (political, controversial, adjacent category) without requiring approval over all use.

  • moderate

Add creator objection rights over specific placements within a defined response window before publication.

  • moderate

Limit brand use to defined contexts (named campaigns, named channels, defined timeframes) rather than unrestricted future use.

  • harder

Pair the absent approval rights with an explicit prejudicial- treatment carve-out preserving the creator's moral-rights objection path.

Negotiating it

A good opening

"Could we add narrow Creator approval rights over specific contexts, political associations, controversial partners, adjacent product categories Creator does not work with, rather than full approval over all use? "

When to walk away

Creator approval absent combined with broad rights grants (worldwide, all media, perpetual), brand modification rights, moral-rights waiver, and broad likeness rights, creates a structure where the creator's name and likeness can be redeployed in any context the brand chooses, indefinitely, without recourse. Strong walk- away signal, particularly where the creator's reputation or political associations are material to the engagement value.
